TO JOIN ACTION UNDER FLSA & Indiana LAW

To Share in Any Possible Recovery of Unpaid Overtime in These Lawsuits Against Alion and SwRI, You Must File a Written Consent to Join Form(s).

If you work or worked for SwRI and/or Alion as a Laboratory Technician, Analyst, Chemist, Monitoring Technician, and/or in another similar hourly-paid position at the NECDF, Newport, Indiana, in the last three years from October 5, 2006, you may be eligible to join this lawsuit for unpaid wages and overtime.

If you are interested in joining the lawsuit(s), you must send in the completed, signed "Consent Form(s)." If you worked for both Alion and SwRI, please complete the consent forms for both cases. Act Promptly -- Delay Could Reduce Any Recovery

In an action or lawsuit under FLSA or Indiana law (Ind. Code. Ann. § 22-2-2-9), a successful claimant or plaintiff may be able to recover alleged unpaid overtime compensation for a limited time period, called the "statute of limitations" period. This period is usually two years under FLSA, but it can be increased to three years if a court finds that an employer "willfully" violated provisions of FLSA. The Statute of Limitations under Ind. Code. Ann. § 22-2-2-9 is three years. The statute of limitations period is triggered when the consent form is filed with a court.

If the Court or a jury determines that any alleged off-the-clock work is compensable time under FLSA and/or Indiana law, as alleged by the Plaintiffs, and if the Court or jury rules that the Plaintiffs are entitled to recovery of alleged unpaid overtime in these lawsuits, only employees who have joined this lawsuit by filing their consent to join would be eligible to share in recovery of unpaid overtime wages as determined by the Court or a jury. As of this time, the Court has not made any determination of merits of Plaintiffs' allegations in the lawsuits.

If it appears that you may be eligible to participate, we will file the consent form(s) with the Court. The Court or a jury will determine the validity of your claim.
